جنسی استحصال اور ریاستی ذمہ داری
تقریبا ایک ماہ پہلے ریاست نے زینب کے قاتل کو تختہ دار پر لٹکا دیا اور تمام ملک میں انصاف کی جیت کے گن گونجنے لگے۔ مگر سوال یہ پیدا ہوتا ہے کہ کیا ایک شخص کو پھانسی دے کر ریاست نے اپنی ذمہ داری پوری کر دی ہے؟ کیا ایک مہینے بعد بھی ہم بحثیت قوم جنسی استحصال کو روکنے کے لیے کی اقدام اٹھا رہے ہیں؟
ریاست کا کام صرف سزا نہیں بلکہ مستقبل کے جرائم کو روکنا بھی ہے۔ کیا ہمارے عدالتی و حکومتی نظام میں اس طرف کوئی رجحان ہے؟ مجرم اور معاشرے کی اصلاح تعلیم اور جانکاری سے ہوتی ہے اور جنسی تعلیم کا کوئی وجود بھی پاکستان میں موجود نہیں۔ قصور واقع کے بعد بھی ایک قومی احتجاج برپا تھا مگر اس سب کے باوجود جنسی تشدد کے واقعات میں کوئی کمی نہیں آئی۔ جب تک ہم اپنے بچوں کو آگاہ نہیں کریں گے کہ کیا صحیح اور کیا غلط ہے، حالات کا بدلنا ممکن نہیں۔
ایک اور بڑا مسلہ یہ ہے کہ جب کوئی شخص اور خاص طور پر خواتین اس بارے میں بات کرتیں ہیں تو ان کو اس لیئے دبا دیا جاتا ہے کہ یہ بات غیرت اور عزت پر داغ کا باعث بنے گی۔ اس سے نہ صرف ہم مجرم کو کھلا چھوڑ دیتے ہیں اور دوسرے لوگوں کو ان کا شکار بنے کے خطرے پر چھوڑ دیتے ہیں بلکہ ہم یہ بھی پیغام دیتے ہیں کہ اصل قصور مجرم کا نہیں بلکہ مظلوم کا ہے۔ اور اس رویئے کی وجہ سے لوگ ان واقعات کے بارے میں بولنے سے کتراتے ہیں اور ایسے مجرموں کو سزا نہیں ملتی۔
ایسی صورت میں ریاست کی یہ ذمہ داری ہے کہ وہ تفتیشی نظام اس قسم کا بنائے کہ مظلوم کو آگے آتے ہوئے کسی شرمندگی اور تنگی کا احساس نہ ہو۔ آج بھی ریاست پاکستان میں ریپ کے مقدمات میں مدعی کو شرمناک ٹیسٹ سے گزرنا پڑتا ہے۔ دو انگلی ٹیسٹ نہ تو سائنس پر اترتا ہے اور نہ کسی منطق پر۔
جب تک ایسے قوانین اور رویئے لوگوں اور ریاستی اداروں میں عام ہے کسی ایک شخص کی پھانسی سے کچھ نہیں بدلے گا۔
